Locked up for 12 months for discharging plating waste to the public sewer system
One of 72 Clean Water Act Criminal Prosecutions in the State of California (from 1989-2023)
The defendants in this case are a Fresno-based metal finishing company and key personnel, the owner and operator of the company. The individual and corporate defendants cases were heard in federal district court in California with the judgement and sentencing completed in fiscal 2003.
The defendants were charged with ten counts each, violations of the Clean Water Act, for knowingly discharging toxic metal plating wastewater, in excess of permit.
The defendants pled guilty to all charges. The owner-operator received a prison sentence with two years probation and a $50,000 federal fine. The corporation was sentenced to three years probation and a federal fine of $350,000.
Incarceration: 12 months; Federal Fines: $400,000; Restitution: $0; Special Assessment: $500; Probation: 60 months
