Over-application of organic liquid waste on a tile-drained field is regarded as illegal discharge to the waterway

One of the largest confined animal operations in the state of Ohio was charged under the Clean Water Act for negligently discharging waste into state waters.

Saturating a tile-drained farm field with liquid organic wastewater from concentrated animal feeding operation was determined by the judge as an illegal discharge directly to the creek.  The CAFO corporate was sentenced to a $150,000 federal fine and further ordered to pay $150,000 restitution disbursed to three local environmental organizations as a community service.  A contractor to the concentrated animal feeding operation was also sentenced to three years probation for his role in ordering the application of wastewater in excess of permitted discharge.  The facility was ordered by the court to make a number of improvements, including adding more surface area for future wastewater disposal.

Probation: 72 months; Federal fines: $150,000; Restitution/Community Service: $150,000
